Terms & Conditions

SAMAN Records Artist Release Agreement

By submitting music to SAMAN Records, accepting a release offer, or signing a release agreement, the Artist agrees to the following Terms and Conditions.

1. Release Agreement

Upon acceptance of a release by SAMAN Records, the Artist grants SAMAN Records the right to distribute, promote, market, and exploit the submitted recordings according to the terms outlined herein.

2. Distribution Rights

SAMAN Records retains exclusive digital distribution rights for accepted releases for a period of seven (7) years.

This includes, but is not limited to:

  • Spotify
  • Apple Music
  • Beatport
  • Amazon Music
  • YouTube Music
  • Deezer
  • TikTok
  • Meta Platforms
  • Any future digital platforms

SAMAN Records also retains exclusive physical distribution rights for seven (7) years, including:

  • Vinyl Records
  • Compact Discs (CD)
  • Cassettes
  • Any future physical formats

3. Copyright & Ownership

The copyright ownership of sound recordings and compositions shall be governed by the individual release agreement signed between the Artist and SAMAN Records.

Where applicable, SAMAN Records may register copyrights, metadata, ISRC codes, UPC codes, and publishing information necessary for the commercial exploitation of the release.

4. Artist Responsibilities

The Artist represents and warrants that:

  • All submitted material is original or properly licensed.
  • The Artist has full authority to enter into this agreement.
  • The recordings do not infringe upon any third-party copyrights, trademarks, or intellectual property rights.
  • Any samples used have been properly cleared.

The Artist agrees to indemnify and hold harmless SAMAN Records from claims resulting from unauthorized use of copyrighted material.

5. Royalties

Unless otherwise stated in writing:

  • Artists shall receive 50% of net royalties generated from digital sales and streaming.
  • Artists shall receive 50% of net royalties generated from physical sales after recoupment of manufacturing and distribution costs.

"Net royalties" means revenue remaining after reasonable expenses related to:

  • Manufacturing
  • Distribution
  • Marketing
  • Promotion
  • Advertising
  • Packaging
  • Administrative expenses

6. Royalty Reporting

Royalty statements are issued semi-annually.

Payments, when applicable, are made within sixty (60) days following the close of each reporting period.

7. Publishing & Licensing

SAMAN Records may seek opportunities involving:

  • Publishing
  • Synchronization Licensing
  • Compilation Licensing
  • Sub-Publishing Agreements
  • Third-Party Licensing

Any revenue generated from these activities shall be handled according to the specific release agreement signed by the Artist.

8. Promotion & Marketing

SAMAN Records may use the Artist's:

  • Artist name
  • Images
  • Logos
  • Artwork
  • Promotional materials
  • Biographical information

for marketing, promotional, and commercial purposes related to the release.

9. Physical Products

SAMAN Records may manufacture and distribute physical products associated with a release, including:

  • Vinyl Records
  • CDs
  • Cassettes
  • Merchandise bundles
  • Promotional materials

Manufacturing costs may be recouped before physical royalties are paid.

10. Release Packages

Any promotional, mastering, artwork, playlisting, advertising, or release package purchased through SAMAN Records is considered a service fee and is non-refundable once work has commenced.

Submission or purchase of a release package does not guarantee:

  • Acceptance of a release
  • Editorial playlist placement
  • Streaming results
  • Chart positions
  • Revenue generation

11. Artist Profile Accuracy

Artists are responsible for providing accurate information regarding:

  • Spotify profiles
  • Apple Music profiles
  • Beatport profiles
  • YouTube Music channels
  • Social media accounts

SAMAN Records is not responsible for platform-generated artist mapping errors but will make commercially reasonable efforts to request corrections when necessary.

12. Dispute Resolution

In the event of any dispute, both parties agree to first attempt to resolve the matter through good-faith negotiations before pursuing legal action.

13. Limitation of Liability

SAMAN Records shall not be liable for:

  • Platform outages
  • DSP errors
  • Metadata errors caused by third parties
  • Delayed royalty payments by distributors
  • Delays caused by streaming platforms

14. Termination

SAMAN Records reserves the right to refuse, suspend, remove, or terminate any release that:

  • Violates copyright laws
  • Contains fraudulent content
  • Contains hate speech or illegal material
  • Breaches these Terms & Conditions

15. Governing Law

These Terms and Conditions shall be governed by the laws applicable to SAMAN Records Label LLC.
